Abstract

KPLP is the abbreviation of "Ministry of Transportation and Port Institutions" in Indonesia. KPLP is part of the harbormaster's office and port authority which is tasked with inspecting and testing ships to meet ship safety requirements. To carry out shipping activities, every sea transportation (ship) requires a Sailing/Laying Approval Letter (SPB) issued by the harbor master so that it can sail or dock. In order to obtain SPB, ships that will sail must meet several requirements, such as ship seaworthiness requirements. The results of the study show that each Sailing Approval Letter can be given by a harbormaster to a ship user or owner if the ship has fulfilled several important conditions as stated in Article 117 of the Republic of Indonesia Law Number 17 of 2008 above and other provisions. Syahbandar requires data obtained from a State-Owned Enterprise (BUMN), namely the Indonesian Classification Bureau (BKI), which is a special agency for supervising sea transportation (ships) in the construction and equipment of ships so that the syahbandar can issue letters or documents sea transportation will be used to carry out the voyage. The role of Syahbandar is specifically regulated in Law Number 17 of 2008 concerning Shipping. As long as there are regulations governing the role of a syahbandar in issuing shipping approval letters, it is not uncommon for us to encounter several sea transportation accidents caused by delays in carrying out syahbandar duties, namely by giving shipping permits and ship seaworthiness documents to ships that are not suitable for sailing and ships that do not pass the class test by the Indonesian Classification Bureau are related to cases of ships that are actually not seaworthy but have SPB are old cases that often occur repeatedly in Indonesia and become a phenomenon that is considered normal and this can lead to disobedience in cruise ship. The duties and functions of Syahbandar are specifically regulated in Law Number 17 of 2008 concerning Shipping. Article 207 paragraph (1) of Law Number 17 of 2008 Concerning Shipping states that harbors carry out shipping safety and security functions which include implementation, supervision and law enforcement in the field of transportation in waters, ports, and protection of the maritime environment at ports.
