Abstract

The issuance of a port clearance is a supervisory activity carried out by the seahband on ships that will sail based on a letter from the captain. In ship safety checks or in this case the inspection of ship's sea worthiness, the transportation must check the physical condition of the ship directly, ensure the accuracy / truth of reports from the company / ship. So that it is expected that with the function of inspection, supervision / control can build understanding / attention from the company to complete the ship according to the requirements in the applicable regulations. The research method used in this study is an empirical juridical method that is a procedure used to solve research problems by examining secondary data first to then proceed with conducting research on primary data in the field. Secondary data is obtained by studying and reviewing library materials in the form of legal materials both primary legal materials, secondary legal materials, and tertiary legal materials. Primary data is direct data obtained from data sources in the field and obtained using observation and interviews.The feasibility of the ship's sea is the condition of the ship that meets the requirements of ship safety, prevention of water pollution from ships, manning, loading lines, ship crew welfare and passenger health, ship legal status, safety management and prevention of ship pollution, and ship security management to sail on certain waters. The obligation to have a port clearance is excluded for: warships and / or state ships / government ships as long as they are not used for commercial activities.
