Abstract

Concerning the ship's operational activities which may cause oil contamination, the role of related elements and procedures or prevention of spillage prevention on ships. In accordance with MARPOL 1973/1978 where all ships are required to carry out the implementation of annex I in the effort of preventing the oil spills on the ship, it is necessary to review all matters relating to the prevention of oil contamination (SOPEP). The roles of the procedures, crew and maintenance need to be reviewed in relation to the state of the oil spill on the operational often occurring aboard. The cause of the oil spill also needs to be studied for evaluation and improvement, in which the ship's operations must continue to run without contamination. Damage to marine ecosystems makes marine productivity unbalanced, causing marine biota to decay and die, this is also a bad impact on fishermen's welfare. The purpose of this study is to know and explain the international provisions governing the prevention of oil spills by the ship and its implementation in Indonesian legislation. The results show that the regulation on the prevention of marine pollution caused by the ships in the 1974 convention for the safety of life at sea (SOLAS) and united nations convention on the law of the sea (UNCLOS) has detailed and clear countermeasures pollution can be done well by each State, in the Indonesian republic law number 16 of 2008 on the shipping and government regulation number 19 of 1999 on the control of pollution or destruction in the sea of Indonesia also contains some similar provisions. Based on international regulations and Indonesian national legal regulations are appropriate but in the implementation in the field every ship company has not carefully examined every completeness and condition of the ship resulting in several accidents that result in damage and losses that affect the pollution.
